These Terms of Use ("Terms") govern your use of the Ring Ref application ("Ring Ref," the "App") and related websites, services, and support resources operated by Barder Works LLC ("Barder Works," "we," "us," or "our").
By downloading, installing, purchasing, accessing, or using Ring Ref, you agree to these Terms. If you do not agree to these Terms, do not use the App.
Ring Ref is a timing and reminder tool designed to help calls, sessions, consultations, and other timed conversations stay on track.
Depending on the version and features available to you, Ring Ref may provide audible time checkpoints, visual timing tools, overtime tracking, session-related controls, preferences, and other tools intended to assist with time management.
Ring Ref is not a medical device, emergency service, legal service, therapy service, billing system, clinical documentation system, compliance system, call-recording service, transcription service, or professional recordkeeping system.
Ring Ref does not replace professional judgment, required recordkeeping, informed-consent procedures, privacy practices, supervision, emergency procedures, or regulatory and compliance obligations that may apply to you or your work.
Use of Ring Ref does not make Barder Works responsible for the professional services, conversations, sessions, or other activities in which you choose to use the App.
You are responsible for determining whether Ring Ref is appropriate for your particular use and circumstances.
If you use Ring Ref in connection with professional services, clients, patients, customers, students, employees, or other individuals, you are responsible for complying with all laws, regulations, professional rules, contractual requirements, privacy obligations, disclosures, and consent requirements applicable to you.
You are also responsible for maintaining any records, documentation, safeguards, backup timing methods, or other procedures required for your work.
Ring Ref is intended as a timing aid. You should not rely on Ring Ref as the sole method of determining when a session, appointment, consultation, call, or other activity must begin or end.
Audible reminders and other App behavior may depend on factors outside Barder Works' control, including your device, operating system, volume and audio settings, call configuration, connected accessories, network conditions, other applications, background execution, system interruptions, and changes made by Apple or other platform providers.
We do not guarantee that any reminder, sound, notification, timer event, or other App function will occur at an exact time, remain uninterrupted, or be audible to you or another participant in every configuration.
You remain responsible for monitoring time and for the consequences of starting, continuing, or ending a call or session.
Subject to these Terms and any applicable App Store terms, Barder Works grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use Ring Ref on devices that you own or control.
This license does not transfer ownership of Ring Ref or any intellectual property associated with the App.
Ring Ref may offer subscriptions, one-time purchases, session credits, consumable purchases, or other paid features.
The price, duration, features, and other terms of an available purchase will be displayed in the App or Apple's purchase interface before you complete the transaction.
Purchases made through the App Store are processed by Apple and are also subject to Apple's applicable terms and conditions.
Barder Works does not directly process your App Store payment card information.
If you purchase an auto-renewing subscription, your subscription will renew automatically unless it is canceled in accordance with Apple's App Store subscription procedures.
Apple handles subscription billing, renewal, cancellation, and applicable refund processes for App Store purchases.
You can manage or cancel an App Store subscription through the subscription settings associated with your Apple account.
Deleting Ring Ref from your device does not automatically cancel an active App Store subscription.
Ring Ref may offer free trials, introductory access, promotional offers, or other limited-access periods.
The eligibility, duration, conversion terms, and other conditions applicable to an offer will be presented when the offer is made.
Where a trial or promotional offer converts to a paid subscription, the applicable purchase interface will disclose the relevant terms before enrollment.
Ring Ref may allow users to purchase credits or other consumable access that can be used for eligible sessions or features.
Credits have no cash value, are not currency, do not earn interest, and cannot be redeemed for cash except where required by applicable law.
Credits may be subject to technical, platform, account, restoration, or availability limitations disclosed in the App or imposed by the platform through which they were purchased.
The quantity, price, and applicable use of credits will be shown before purchase.
App Store purchases are processed by Apple. Requests for refunds for purchases made through the App Store are generally handled by Apple in accordance with Apple's applicable policies and applicable law.
Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be limited or waived.
Ring Ref may evolve over time. We may add, modify, replace, limit, or discontinue features or functionality.
We may also change the pricing or structure of subscriptions, credits, or other paid offerings, subject to applicable law and App Store requirements.
Any pricing change affecting an existing subscription will be handled in accordance with applicable App Store rules and any notice or consent requirements that apply.
Your use of Ring Ref is also subject to the Ring Ref Privacy Policy, which describes how information is handled when you use the App and related services.
Ring Ref is designed to provide its timing functionality without recording, storing, or transcribing the content of your conversations.
You agree not to use Ring Ref to:
Ring Ref, including its software, design, branding, graphics, interfaces, text, and other original materials, is owned by or licensed to Barder Works and is protected by applicable intellectual-property laws.
Except for the limited right to use the App granted under these Terms, no rights in Ring Ref or Barder Works' intellectual property are transferred to you.
You may choose to provide feedback, suggestions, feature requests, votes, ideas, or other input about Ring Ref.
You agree that Barder Works may use, evaluate, develop, adapt, and incorporate that feedback for the purpose of operating, improving, and developing Ring Ref and other Barder Works products, without an obligation to compensate you.
Providing feedback does not guarantee that a requested feature or change will be implemented.
Ring Ref depends in part on technologies and services provided by third parties, including Apple and the operating system and App Store environment in which the App operates.
Changes, outages, restrictions, or technical behavior of third-party services may affect Ring Ref's functionality or availability.
Barder Works is not responsible for third-party services, products, terms, policies, or systems that we do not control.
We may release updates, corrections, improvements, or new versions of Ring Ref from time to time.
Some functionality may require a supported device, compatible operating-system version, internet connection, iCloud availability, App Store access, or an updated version of Ring Ref.
We do not guarantee that Ring Ref or any particular feature will always be available, uninterrupted, compatible with every device or service, or free from errors.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RING REF AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
BARDER WORKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that Ring Ref will meet every user's requirements, operate without interruption, produce a particular professional or business result, or be free from defects or errors.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BARDER WORKS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO RING REF OR YOUR USE OF THE APP.
This includes, without limitation, losses arising from missed or inaudible reminders, inaccurate or interrupted timing, continued or prematurely ended sessions, device or software behavior, loss of data, loss of business, lost profits, professional consequences, or reliance on Ring Ref in place of your own judgment, procedures, or obligations.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BARDER WORKS' TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO RING REF WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BARDER WORKS FOR RING REF DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50).
The limitations in this section apply to the fullest extent permitted by law. Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Barder Works LLC and its members, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of Ring Ref, your violation of these Terms, or your violation of the rights of another person.
You may stop using Ring Ref at any time.
We may suspend, restrict, or terminate access to Ring Ref or related services if reasonably necessary to protect Ring Ref or its users, comply with law, prevent fraud or abuse, or address a material violation of these Terms.
Termination of access does not automatically cancel an App Store subscription. App Store subscriptions must be managed through Apple.
We may update these Terms as Ring Ref evolves or as legal, operational, or platform requirements change.
When we update these Terms, we will revise the "Last updated" date above. If required by applicable law, we will provide additional notice of material changes.
Your continued use of Ring Ref after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
These Terms are governed by the laws of the state in which Barder Works LLC is organized, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise.
Nothing in these Terms limits any consumer protection or other statutory rights that cannot legally be waived.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
These Terms, together with the Ring Ref Privacy Policy and any additional terms presented in connection with a particular feature or purchase, constitute the agreement between you and Barder Works concerning your use of Ring Ref.
